In view of the explanation rendered, sufficient cause is shown for the delay in filing the appeal. The delay of 40 days is condoned in terms of prayer at Paragraph 4.(a) of the application.

Accordingly, the Application is allowed. Rule is made absolute to the aforesaid extent.
