Heard Sri K.N. Kesharwani, learned counsel for the petitioner, Sri B.K. Yadav, learned counsel for the respondent no.5 and the learned Standing Counsel for the respondents no. 1 to 4.
The petitioners who are three in number are seeking a direction to the respondents no. 2 and 3 to convene the meeting of Gram Sabha Bhataura, Pargana Jaswant Nagar, District Etawah for considering the motion of non-confidence against the respondent no.5. Respondent no.5 is the elected Gram Pradhan. Affidavits filed as Annexure-2 to the writ petition for withdrawing the support given to the respondent no.5 with a request that a no-confidence motion be called. It is clear that on these affidavits dated 8.1.2018, the Assistant Development Officer (Panchayat), Jaswant Nagar, Etawah has also recommended that Technical committee be constituted to enquire into the allegations.
No useful purpose would be served in keeping the petition pending.
This writ petition is disposed of with a direction to the respondent no.2-District Magistrate, District Etawah to enquire into the matter and pass appropriate orders, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
