Under order of Writ Court dated 23.3.2018, the applicant became entitled to arrears of salary from 14.12.2012 to 17.8.2016 and post retiral dues after 17.8.2016 within a period of six weeks from the date of presentation of certified copy of the order.
Counsel for the applicant points out that a certified copy of the order of the Writ Court was sent to the opposite party by registered post on 14.5.2018 followed by reminder dated 6.7.2018, but neither arrears of salary have been paid nor the retiral dues.
This Court is of the opinion that before inaction on part of the opposite party in payment of arrears of salary and retiral dues to the applicant is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order alongwith fresh representation before the opposite party and in which event, he shall ensure due compliance of the directions issued by the Writ Court within next six weeks, failing which, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
