The petitioner was allotted a land by the Industrial Development Corporation and pursuant thereto the petitioner deposited certain amount, but the full and final amount could not be deposited. Learned counsel for the petitioner filed this writ petition praying to allot and hand over Plot No. C88 Sector-1, Industrial Area Tala Nagari, Aligarh.
Shri M.N. Singh, learned counsel appearing for the U.P. State Industrial Development Corporation Ltd. submits that the allotment has already been cancelled by order dated 24.11.2003 which has not been challenged, therefore, the writ petition has been infructuous.
Shri Jai Prakash Mishra, learned counsel for the petitioner submits that he was never served with the order of cancellation.
Since the order of cancellation has been shown to the learned counsel for the petitioner, he may take appropriate remedial step. So far as this writ petition is concerned, since the allotment has already been cancelled, the writ petition has been rendered infructuous. It is, accordingly, dismissed.
