JUDGMENT / ORDER

1. This petition under Article 226 of the Constitution of India, has been preferred, with the following prayers:
"(A) Admit present petition.
(B) Allow present petition by directing the respondents to grant the permission to the petitioner to sell out his residential premises constructed on plot NO.49 of the Society pursuant to the policy framed vide Government Resolution dated 4/4/2001, forth with, in the interest of justice.
(C) Grant interim relief by directing the respondents to decide the Application dated 19/6/2009 (Annexure "B" to the petition), by keeping in mind the Government Resolution dated 4/4/2010, in the interest of justice and equity.
(D) Award the costs of present petition.
(E) Grant such other and further relief/s as may be deemed fit, just and proper in the facts and circumstances of the case, in the interest of justice."
2. Notice was issued in the petition on 6-5-2011. When the matter is taken up today, Mr.Pranav S.Dave, learned Assistant Government Pleader, states upon instructions from the office of the Collector, Rajkot that upon the representation dated 19-6-2009 (Annexure 'B') made by the petitioner, the Collector, Rajkot has issued notice on 27-2-2012.The communication in this regard dated 27-2-2012, tendered by the learned Assistant Government Pleader, is taken on record.
3. Mr.M.A.Kharadi, learned advocate for the petitioner states that the directions may be issued to the competent authority to decide the representation, within a time bound period.
4. Upon the above statement being made by learned counsel for of the respective parties,the following order is passed:
The competent authority shall consider and decide the representation dated 19-6-2009 made by the petitioner, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
5. The petition is disposed of, in the above terms, without entering into the merits of the case.
Direct service of this order is permitted.
