JUDGMENT / ORDER

Application for bail under Sec.439 of Cr.P.C. 2. Petitioner is the 3rd accused in Crime No.311 of 2014 of Koduvally Police station registered for offences punishable under Secs.363, 325, 307, 384, 452 and 364A read with Sec.34 of IPC. He was arrested on 12.09.2014.
3. The prosecution allegation is that accused nos.1 to 4 in furtherance of their common intention kidnapped son of the defacto complainant from his residence and attempted to commit murder by suffocation.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. Learned counsel for the petitioner submitted that the 1st accused in this case was released on bail by this Court as per order dated 12.09.2014 in B.A. No.6586 of 2014.
6. Learned Public Prosecutor opposed the bail application by contending that the accused are members of a gang distributing hawala money.
7. Considering the stage of investigation, bail is granted to the petitioner with the following conditions.
i. The petitioner shall be released on bail on his executing bond for Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties for the like sum to the satisfaction of the Judicial First Class Magistrate Court-I, Thamarassery.
ii. The sureties shall produce documents to establish their identity and solvency.
iii. The petitioner shall report before the investigating officer on all Saturdays between 9.00 a.m. and 10.00 a.m. until final report is filed.
iv. The petitioner shall surrender his passport forthwith. If he does not have the same, shall file affidavit to that effect before the said Court
v. The petitioner shall not intimidate or influence the witnesses or meddle with the investigation.
vi. The petitioner shall not involve in any other crime during the pendency of this case.
vii. The petitioner shall co-operate with investigation of the case.
viii. If any one of the above conditions is violated by the petitioners, the learned Magistrate is free to cancel the bail.
