By means of the instant petition, the petitioner has challenged the order dated 3.1.2018 whereby the appellate court has rejected the application filed by the petitioner for admitting additional evidence in exercise of provision under Order 41 Rule 27 CPC.
In the opinion of the Court, the order impugned is purely an interlocutory one and it could be subjected to challenge alongwith the final judgement.
Accordingly, this petition stands disposed of at this stage with liberty reserved in favour of the petitioner to challenge the impugned order alongwith the final judgement passed in appeal, in case situation arises for challenging the final judgement.
