Heard Sri Indra Raj, learned counsel for the applicant and G.P. Singh, learned A.G.A for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 04.07.2017 passed by Juvenile Justice Board, Agra and further be pleased to direct the Juvenile Justice Board Agra to determine the age of applicant on the basis of application moved by applicant on 30.3.2017 before concerned court at Agra and order dated 30.3.2017.
Learned counsel for the applicant submits that the applicant had claimed plea of juvenile before Juvenile Justice Board, Agra as he was confined in jail hence, learned trial court rejected the application on the ground that it has no jurisdiction to entertain such an application.
Learned AGA opposed the prayer and submitted that the applicant had been convicted for the offence in question alongwith T.A.D.A. and confined in jail in District Agra and his appeal has also been dismissed by the Apex Court to which the learned counsel for the applicant states that in view of the PIL filed before this Court he has moved an application claiming himself to be juvenile, hence direction be given to Juvenile Justice Board, Agra to consider the application afresh at Agra.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order does not suffer from any irregularity, illegality or jurisdictional error, hence no interference is required by this Court. The prayer for quashing the impugned order is refused.
The present 482 Cr.P.C. application lacks merit and is, accordingly, dismissed.
