The present petition has been filed with the following prayers:-
"A. Issue a writ, order or direction in the nature of mandamus directing the respondents to grant third time scale to the petitioner a per the office memorandum dated 14.08.2010 and to make the payment of arrears of salary of the petitioner from the dte of enforcement of above mentioned third scale.
B. Issue a writ, order or direction in the nature of mandamus directing the respondents to determine the pay fixation of the petitioner once again according the office memorandum dated 14.08.2010."
The contention of learned counsel for the petitioner is that despite the petitioner being entitled was not given the benefit of time scale and thus error has occurred in payment of retiral dues as well as other dues to the petitioner. The petitioner claims to have filed a representation, which is not being decided so far.
Considering the fact that the decision is to be taken by the respondent no. 2, the present petition is disposed off with a liberty to the petitioner to file a fresh representation alongwith a copy of this order before the respondent no. 2. In case such a representation is filed, the same shall be decided in accordance with law, as expeditiously as possible, preferably within a period of two months from the date of production of a copy of this order before the respondent no. 2.
The writ petition is disposed off.
