JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to complete the construction of his house.
From jail remarks, we find that the applicant was already on temporary bail in August-September, 2011 and in January, 2012.
Considering the totality of the facts, discretion does not deserve to be exercised.
Hence, application is rejected. Rule discharged.
