JUDGMENT / ORDER

The petitioner has filed the present writ petition praying to settle all terminal benefits like payment of leave salary, balance amount due to him towards gratuity, refund of caution deposit, commutation of pension and pension arrears with interest at 12% p.a.
2. The respondent has filed a counter affidavit. In paragraph 4 of the counter affidavit, the respondent has furnished the particulars of the amount settled to the petitioner. The said amount has been received by the petitioner. There is no objection made by the petitioner at the time of receiving the said amount. Therefore, nothing survives in the present writ petition.
3. The learned Counsel for the petitioner also fairly accepted the said factum of the counter affidavit filed by the respondent regarding payment of amount which was received by the petitioner. However, he seeks liberty to the petitioner, to approach the Corporation authorities, if any amount is unsettled by the Corporation, as per law.
4. In view of the counter affidavit filed by the respondent in the writ petition, the writ petition is dismissed with liberty to the petitioner to approach the authority for unsettled amount, if permissible under law. No costs.
