Heard learned counsel for the petitioner, learned Standing for the respondent no.1 and Sri Rohit Pandey, learned counsel for the respondent no.2.
Present petition has been filed with the following prayer:-
"To issue a writ, order or direction in the nature of mandamus directing and commanding the respondents to pay compensation of Rs.3 Lakhs to petitioner in pursuance of the order dated 21.12.2016 passed by this Hon'ble Court in Writ-C No.24853 of 2016 (Sankalp Institute of Education Vs. State of U.P. and 2 others) which has been affirmed by the Division Bench of this Hon'ble Court vide order dated 10.3.2017 (Annexures 3 and 6 respectively to the writ petition), within some specific period to be fixed by this Hon'ble Court."
Sri Rohit Pandey, learned counsel for the respondent no.2 has raised preliminary objection and submitted that this writ petition is not maintainable and petitioner is having remedy of filing contempt petition for enforcement of order passed by this Court.
Under such facts and circumstances of the case, no writ of mandamus can be issued for compliance of order passed by this Court and petitioner may approach Contempt Court, if so advised.
Accordingly, the writ petition is dismissed as not maintainable. No order as to costs.
