Hon'ble Ajay Bhanot,J.
Sri Manoj Kumar, learned counsel for the petitioner, submits that the petitioner undertakes, to make an application for her answer-sheets in the prescribed format and also deposit the requisite fee, in the subjects of English, Mathematics, Physics and Chemistry of the Intermediate Examination-2019. The only prayer, made by the learned counsel for the petitioner, is that the aforesaid representation may be decided, within a stipulated period of time.
Learned Standing Counsel, submits that in case the petitioner submits an application in her prescribed format and deposits the requisite fee, and the answer-sheets have not been weeded out as per law, the respondent-authority is under obligation of law, to decide the representation of the petitioner.
In the light of the submissions, made by the learned counsel for the parties, the matter is remitted, to the respondent No.2- Secretary, Board of High School and Intermediate Education, Uttar Pradesh, Prayagraj.
The petitioner shall make the application, in the prescribed format, and also deposit the requisite fee before the respondent No.2-Secretary, Board of High School and Intermediate Education, Uttar Pradesh, Prayagraj within one week. The, respondent No.2-Secretary, Board of High School and Intermediate Education, Uttar Pradesh, Prayagraj, shall decide the representation of the petitioner for copies of the answer- sheets, in the subjects of English, Mathematics, Physics and Chemistry of the Intermediate Examination-2019, within a period of two weeks, from the date of, receipt of, a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions, made in the writ petition, nor the claim of the petitioner has been judged on merits. It is for the competent authority, to do so after independent application of mind, in accordance with law.
With the aforesaid directions, the writ petition is finally disposed off.
