1. Heard learned advocate Mr. Jadeja for learned advocate Mr.Majmudar.
2. The applicant has taken out present application seeking below mentioned relief:
"8(ii) pass appropriate order and be pleased to direct the Registry to notify the captioned petition being Special Civil Application No.9399/2010 for final hearing in view of the peculiar facts and circumstances mentioned herein above."
3. Learned advocate Mr. Jadeja for the applicant has submitted that the applicant suffers from 80% physical disability and since 2008. The applicant has challenged the termination order and the departmental proceedings in the petition i.e. Special Civil Application No.9399 of 2010. In these facts and circumstances of the case, the applicant has requested for early hearing of the said petition.

Having regard to the fact that the petition has been filed in 2010 and has been admitted in 2010 and considering the fact that the petitions which are filed earlier to present petition are pending for final hearing, if the request of the applicant is considered and granted, it would amount to allowing the preferential and out of turn hearing of present petition. The Court has while admitting the petition directed that the petition to be heard with Special Civil Application No.15003 of 2003. The office is, therefore, directed to list present petition along with Special Civil Application No.15003 of 2003 for final hearing.
5. With the aforesaid clarification, present application stands disposed of.
