Heard Mr. Dave, learned Senior Counsel appearing with Mr. Jigar M. Patel, learned Advocate for the petitioners.
It is repeatedly asserted by learned counsel for the petitioner that even after the amendment in the Ordinance and the Rules, until now any resolution conferring authority upon respondent No.2 to appoint Dean has not been passed in any of the meetings of Syndicate i.e. until today Syndicate has not taken any decision and has not passed any resolution with regard to appointment of respondent Nos. 3 and 4 as Dean in faculty of Pharmacy and faculty of Engineering.
In view of the said assertion, office is directed to issue Notice so as to ascertain the factual aspect. Notice to be made returnable on 28th March 2012. Direct service is permitted.
