Antony Dominic, J. The applicants in OA No.1445/2014 are the petitioners. By its order dated 14th of August, 2014, the Kerala Administrative Tribunal disposed of the OA directing the Government to consider Annexure A3 representation made by the petitioners, aggrieved by Annexure A1 order passed by the 4th respondent transferring them from Alappuzha District to Idukki and Palakkad Districts. However, in the order passed by the Tribunal, it was directed that while passing orders on their representation, the 1st respondent shall ensure that the cadre strength of Lab Technician Grade I sanctioned to Alappuzha District shall not be exceeded. This admittedly is overlooking the fact that the very case of the applicants was that the cadre strength should be maintained on a state wide basis and not treating district as the unit. In such circumstances, we feel that the observation to that effect in the impugned order was unnecessary and the entire issue ought to have been left to the consideration of the 1st respondent.

Therefore, this OP is disposed of deleting that part of Ext.P6 order passed by the Tribunal directing that while considering the representation, the cadre strength of Lab Technician Grade I sanctioned for Alappuzha District is not exceeded and that Lab Technician Grade I shall be posted only to the sanctioned strength of that post. The 1st respondent shall dispose of the representation as ordered by the Tribunal untramelled by the above.
