This Criminal Original Petition has been filed to modify the condition imposed on the petitioner by order dated 05.05.2017 and made in CMP No.748 of 2017 in CC No.12/2017 on the file of Judicial Magistrate No.II, Tirupur.

3. The Judicial Magistrate No.II, Tirupur, by Order dated 5.5.2017 in CMP No.748 of 2017, while dispensing with the personal appearance of the petitioner, imposed one of the conditions to the effect that “(i) The petitioner/accused shall appear, receive free copies of this case and shall execute a bond for Rs.5,000/- (Rupees five thousand only) along with two sureties like sum to the satisfaction of this Court in terms of Section 88 of Code of Criminal Procedure, in the next hearing on 02.06.2017 without fail”.
4. Such condition cannot be claimed onerous. Since the matter is of summons case in nature, the above condition imposed by the learned Judicial Magistrate is modified by relaxing execution of bond for Rs.5,000/- alone and the other conditions imposed by the learned Magistrate, Tirupur by order dated 5.5.2017 in CMP No.748 of 2017 remain unaltered. With the above modification, the criminal original petition is disposed of.
