Heard Mr.Sankar Ramasamy, learned counsel for petitioner, Mr.S.N.Parthasarathy, learned Government Advocate, appearing for respondents 1, 3 and 4, Mr.Iniyen, learned counsel for the 2nd respondent and Mr.S.Pattabiraman, learned Government Advocate for the 5th respondent.
2. The petitioner has filed the above writ petition to issue a writ of mandamus directing the 3rd respondent to dispose of the appeal filed by him on 02.01.2017.
3. The learned counsel appearing for the petitioner submitted that inspite of the appeal being filed by the petitioner on 02.01.2017, the 3rd respondent has not disposed of the same so far. Further, the learned counsel submitted that under the provisions of the Act, the appeal has to be disposed of within a period of one month.
4. Mr.S.N.Parthasarathy, learned Government Advocate, appearing for respondents 1, 3 and 4 submitted that the 3rd respondent may be directed to dispose of the appeal in accordance with law, within a time frame.
5. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the petitioner in the writ petition, without expressing any opinion with regard to the merits of the case, I direct the 3rd respondent to dispose of the appeal petition filed dated 02.01.2017 by the petitioner, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above observation, the writ petition is disposed of. No costs.
