This Criminal Appeal is filed under Section 374(2) of Cr.P.C., against the order of conviction and sentence passed by the learned Additional District and Sessions Judge, Fast Track Court No.I, Chengalpattu in S.C.No.226/2008 on 15.06.2009 to undergo 7 years Rigorous Imprisonment u/s 304(1) IPC with Rs.1000/- fine in default to undergo further 1 month Rigorous Imprisonment and to set aside by allowing this appeal.

JUDGEMENT
The Criminal Appeal has been filed against the order of conviction and sentence passed by the learned Additional District and Sessions Judge, Fast Track Court No.I, Chengalpattu in S.C.No.226 of 2008 on 15.06.2009.
2. Today, when the matter was taken-up for hearing, the learned Government Advocate appearing for the respondent submitted that pending appeal, the Appellant/Sole Accused died on 17.08.2015. He also filed a memo along with copy of the Death Certificate of the deceased Accused/A.Kumar.
3. Recording the submission of the learned Government Advocate taking into account the memo filed by him, this Criminal Appeal is dismissed as abated. The said memo shall form part of this order.
