Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Petitioner is before this Court assailing the validity of order dated 29.10.2018 passed by Deputy Commissioner (Food) Bareilly Mandal, Bareilly to the extent of rejection of the stay application of petitioner in Appeal no.318 of 2018.
At the very outset, learned counsel for the petitioner has submits that petitioner has confined his prayer to the extent that the appeal in question may be decided by the Appellate Authority at the earliest.
Learned Standing Counsel very fairly submits that in case any such appeal is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending. The writ petition, on consent, is disposed of with the direction to the Deputy Commissioner (Food) Bareilly Mandal, Bareilly to decide the aforesaid appeal so filed by the petitioner expeditiously, preferably within a period of six months from the date of production of certified copy of this order but certainly after providing ample opportunity of hearing to all the stake holders in the matter.
